You must be legally able to enter a contract and authorized to act for the business using the Service. You are responsible for accurate account information, safeguarding credentials, assigning appropriate permissions, and all activity under your account.
Subscriptions and Billing
Paid plans renew automatically for the billing period selected unless canceled according to the cancellation process. Fees, trials, usage charges, taxes, refunds, upgrades, and downgrades are governed by the order or plan presented at purchase. You authorize the applicable payment provider to charge amounts due. Past-due accounts may be limited or suspended.
Permitted Use
You may use the Service for lawful business purposes. You may not misuse the Service, interfere with security or availability, attempt unauthorized access, reverse engineer restricted components, transmit malware, violate third-party rights, or use communications features without the consents required by law.
Customer Communications and Compliance
You are responsible for your calls, texts, emails, recorded communications, marketing campaigns, and customer data. You must comply with applicable privacy, telemarketing, messaging, recording, anti-spam, contractor-licensing, consumer-protection, and industry rules, including opt-in and opt-out requirements. FastTract does not provide legal advice.
Customer Data and Integrations
You retain rights in data you submit. You grant FastTract the limited rights needed to host, process, transmit, and display that data to provide and secure the Service. Third-party integrations are governed by their own terms and may change or become unavailable.
AI-Assisted Features
AI features may generate drafts, summaries, recommendations, or actions. Output may be incomplete or inaccurate. You are responsible for review, approval, and use of AI output, especially for pricing, contracts, safety, financial, legal, and customer-facing decisions.
Intellectual Property
FastTract and its licensors own the Service, software, branding, documentation, and related intellectual property. These Terms provide a limited, non-exclusive, non-transferable right to use the Service during an active account; no ownership is transferred.
Availability and Changes
We may improve, modify, limit, or discontinue features and may use service providers to operate the Service. We do not guarantee uninterrupted or error-free operation. Scheduled or emergency maintenance may occur.
Confidentiality and Security
Each party will use reasonable care to protect the other party’s non-public confidential information. You are responsible for configuring access, integrations, retention, exports, and security settings appropriate for your business.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties not expressly stated in a signed agreement.
Limitation of Liability
To the extent permitted by law, FastTract will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Any aggregate liability cap and exclusions must be confirmed in the final legally reviewed version.
Indemnification
You are responsible for claims arising from your content, communications, unlawful use, violation of these Terms, or infringement of third-party rights, subject to the final legally reviewed agreement.
Termination
You may stop using the Service and cancel according to your plan. We may suspend or terminate access for nonpayment, security risk, unlawful activity, or material breach. Provisions that by nature should survive termination will survive.
Governing Law and Disputes
